Terms & Conditions
1. First come first serve
In other words, if we receive your deposit and another couple has taken up your slot before you put your deposit, we will no longer take your booking, and your deposit will be refunded. We would recommend you putting a deposit as soon as you have decided that you want us to make your cake to avoid disappointment. We only take a maximum four bookings in a day.
2. 50% Non-refundable deposit required
When ordering a cake with Frosty Cakes Co., you would need to put a non-refundable deposit down to secure your slot for that date. If there is a change on your date, please let us know as soon as possible so we can try to accommodate to the change of date and there will either be a slight charge, or it would be voided depending on our schedule.
3. Full payment is required two weeks before wedding date
We reserve the right not to deliver the cake unless the payment has been paid received in full.
Deposits are non-refundable but are transferable depending on circumstances and dates. Full payment of the cake balance is required if cancellation is within one month of the wedding date. 50% payment of cake balance is required if cancellation is within three months of the wedding date. All cancellations must be submitted by email through email@example.com or by message to our page www.facebook.com/frostycakesco. The remaining amount must be paid within 14 days of notification. Any unpaid balances will be pursued through the small claims court, and customers will be responsible for all cost and expenses incurred in this process. This clause can be changed only by Frosty Cakes Co. depending on the customer’s circumstances as we understand somethings are out of your control.
5. When using fresh flowers on cakes
We will inform you that the flowers need to be wired and taped for safety purposes. Please make sure that you talk to your florist about which flowers are safe to use on cakes as not all flowers are appropriate for cake decoration. Some flowers are naturally toxic for consumption and others are inappropriate because of pesticide use. Frosty Cakes Co. will not be liable for any mishaps, damage, illness caused by the flowers inserted into the cake.
6. Customer Pick Ups
Frosty Cakes Co. is not liable for any damages done to your cake once it leaves our facility and is handed over to you. The customer is now responsible for the cake. We recommend having two people when collecting cake so that one could hold the cake while the other person drives. Depending on the damage caused when handling the cake, we might be able to repair it with additional cost.
Delivery times cannot be guaranteed but are generally between 2 pm to 6 pm. The Customers are responsible for confirming the expected delivery timeframe with their reception/venue manager or wedding coordinator. Equipment and cake tables must be set up and checked and ready for us to arrive before the start of this time range. All equipment must also be in place if we are not the providers. Depending on weather conditions, deliveries to outdoor sites are scheduled as close to the event time as possible. Frosty Cakes Co is allowed to move or make any last-minute changes to cake table location if we feel that it will damage the cake or if the table location is unsuitable. Please bear in mind that any delay to delivery affects not only Frosty Cakes Co. but also all customers that are expecting a delivery following yours.
8. Venue Conditions
Frosty Cakes Co. reserves the right to refuse to set up a cake in any locations if we that it is not adequately air conditioned weatherproofed or on any stand/table that appears to unstable/not sturdy to hold the weight of the cake. We will try our best to coordinate with the venue’s staff to find a better placement suited for your cake. However, if we do have other deliveries on that day, we cannot promise that we can resolve the issue as it was mentioned that it is the customer’s responsibility that the cake tables and equipment are all set up and checked before the arrival of the cake. Frosty Cakes Co. will not be liable for any damage caused by the tables or equipment that were unable to withstand the weight of the cakes or inappropriately installed. Frosty Cakes Co. is also not liable for any damage caused by others after the cake is set up.
9. Outdoor Venues
Outdoor venues are incredibly unpredictable. Frosty Cakes Co. will do everything in our power to minimize weather damage to the cake, cake and sugar will melt in temperatures above 23 degrees and high humidity. We are not responsible for damage caused by weather. Common damages in outdoor venues are sweating of the cake, water condensation on the cake, running of colors in the buttercream/fondant, melting buttercream, sliding of decorations, insect attractant.
Frosty Cakes Co. is a licensed, insured and health permitted bakery. We can attempt to reduce some allergens in your cakes but we cannot ensure that cross contamination in our common preparation area will not happen. We process known allergens such as dairy, corn, gluten, eggs and all kinds of nuts. Customers agree to inform their guests of the allergen risks, and Frosty Cakes Co. will not be liable for any allergic reaction.
We, Frosty Cakes Co. rent customers a free of charge option of cake stands, cupcake and macarons towers, cupcake stand and all other equipment. It is the customer’s responsibility to return any equipment used after the event within five working days unless there were alternative arrangements agreed before the wedding. There is a bond collected when hiring the equipment and will be refunded upon returning the equipment in perfect condition. Frosty Cakes Co. can refuse to return the bond if there is any damage to the equipment. Customers that have misplaced or lost the equipment will not only be charged a $100 fee as compensation (subjected to change depending what item/s was hired) but also their bond will not be refunded back to them.
Frosty Cakes Co. reserves the right to use any images of your cake(s) and desserts made by us for publication, marketing, advertising and promotional purposes at any date, before, during and after set up, including scene type photos of the event locations. Photos that include the couple will be contacted personally to ask for permission before posting.
13. Variation in design
We, Frosty Cakes Co. will try our best to match your cake design desired, however, every cake is different and may be subjected to variations. 100% color matching is sometimes not possible due to food grade dyes. We are not able to match a color explained verbally or using paint samples as they have either not been created or used non-food grade dyes (e.g., paint samples). We are also not able to match colors that are shown on electronic devices as monitors display colors differently. To maintain steadiness and the dependability of your cake, Frosty Cakes Co. reserves the right to make any design and structural changes to your cake on site or off, without prior notification to the customer when they feel like it is the best choice for your cake.
14. Natural disasters
Performance of this agreement is contingent upon the ability of Frosty Cakes Co., to complete this agreement when delay or default is caused by conditions beyond its control, including but not limited to, Acts of God, Government restrictions, war, terrorism, criminal act, insurrection, and/or any other causes beyond the reasonable control of the company.
Any refunds given for disputes regarding a cake design or production of design are entirely at the discretion of Frosty Cakes Co. and are not automatic. Disclaimer: Full refunds will not be given for any cake under any circumstances which have been consumed regardless of dispute, as consumption of the cake is viewed as your acceptance that the cake is adequate for the purpose for which it has been supplied. Customers are to contact us to resolve the issue before leaving a negative review on any of our platforms. If the dispute has been settled privately, customers are not allowed to mention how what and when it happens on any platform relating to us.
16. Cake Decorations
Cake toppers, ribbons, ornaments and other cake decorations should be brought to us one week before your event, so they can be assessed before putting on the cake. This way if there is something that needs to be done to them we will have time to sort it out. Frosty Cakes Co. reserves the right not to put any decorations provided by the customer if they feel it is a hazard or will cause damage to your cake.
Frosty Cakes Co. is limited to the liability cost of your cake(s) order.
18. Accepting our Terms and Conditions
By paying a deposit to Frosty Cakes Co., the customer(s) are automatically agreeing and is aware of our Terms and Conditions. Frosty Cakes Co. is allowed to change/edit terms and condition before notification.
